Gunderson Testifies in First Trial via Zoom – $1.9 Billion Verdict
DALLAS — Lance Gunderson, Echelon’s intellectual property practice leader, provided expert testimony on damages on behalf of Centripetal Networks Inc. in its patent suit against Cisco Systems Inc. in the nation’s first trial conduct exclusively via Zoom. On October 5, Judge Henry Coke Morgan, Jr. issued his judgment finding that Cisco infringed four of the five asserted patents and that those patents were not invalid. Judge Morgan awarded Centripetal $755.8 million in damages, which he applied a 2.5 multiple due to Cisco’s “egregious” willful infringement. Total damages including prejudgment interest totaled $1.9 billion, making it one of the largest patent damages verdicts ever in the United States. The court also set an ongoing royalty rate that could ultimately increase damages to more than $3 billion.
Commenting on the unique COVID-19-driven trial format, Mr. Gunderson stated, “The entire process went much more smoothly than I expected, especially being the first trial conducted on Zoom. I felt that I was able to communicate effectively during the presentation of my testimony and would certainly be open to providing deposition or trial testimony via Zoom in future matters.” Gunderson also added, “I was very pleased that the court found my analysis and testimony credible and persuasive. Not only did the court’s damages award reflect this, but the opinion bore this out as well.”
